This Privacy Policy explains how Fresh Cannabis Dispensary ("Fresh Cannabis", "we", "us" or "our") collects, uses, shares and protects information when you visit our website, create an account, place an order, or otherwise interact with our delivery service (the "Service").

We collect information in a few different ways:
- Account information — name, email address, phone number, a securely hashed and salted password, delivery addresses, wishlist items, and your marketing communication preference.
- Order information — items purchased, order totals, delivery address, delivery notes, the payment method you select, and order status and history.
- Age & identity verification — your confirmation that you are 21 or older, and, at the point of delivery, visual confirmation of a government-issued photo ID by our delivery staff (we do not photograph, copy or permanently store your ID).
- Device & usage information — pages viewed, browser type, approximate location inferred from your IP address, and how you interact with the Service, collected automatically through cookies and similar technologies described below.
- Communications — messages you send us through the contact form, email, phone, or customer support, which we keep to respond to you and improve our service.
We never collect full payment card numbers. Checkout uses manual, peer-to-peer payment apps, so any payment credentials stay between you and that payment provider.
3. How We Use Your Information
We use the information we collect to:
- Create and maintain your account, and let you save addresses, reorder favorites, and track order status.
- Process, verify, prepare and deliver your orders, including confirming payment and coordinating with delivery staff.
- Confirm you meet the minimum age requirement and prevent sales to anyone under 21.
- Send transactional messages (order confirmations, payment reminders, delivery updates) and, if you opt in, marketing and loyalty communications.
- Detect and prevent fraud, abuse, and violations of our Terms of Service.
- Maintain, secure, and improve the Service, understand usage trends, and troubleshoot issues.
- Comply with New York State cannabis regulations and other legal obligations, including recordkeeping requirements.
5. Payments & Financial Information
Because Fresh Cannabis uses manual, peer-to-peer payment methods rather than a card processor, we do not collect or store your card numbers, bank account details, or payment app passwords. We only see:
- The order total we ask you to send and the reference number you're asked to include in the payment note.
- Confirmation from our team that a payment has been received, which is recorded against your order.
- Any payment handle nickname or label you choose to save to your account for faster checkout next time.
Transactions sent through third-party payment apps are governed by that provider's own privacy policy and security practices, which we do not control.
6. Delivery & Location Information
To fulfill your order, we share the minimum information necessary with the staff or courier delivering it: your name, delivery address, phone number, order contents, and any delivery notes you provide. Approximate location (such as the location you shop from) may also be used to show accurate menus, pricing and delivery availability.
8. Data Security
We use reasonable administrative and technical safeguards to protect your information, including hashing and salting passwords before they are ever stored, restricting staff access to what is necessary to do their jobs, and using secure connections to transmit data.
No method of transmission or storage is completely secure. While we work hard to protect your information, we cannot guarantee its absolute security, and you share information with us at your own risk. If we become aware of a breach affecting your personal information, we will notify you as required by applicable law.
9. Data Retention
We retain account and order information for as long as your account is active, and for a reasonable period afterward to comply with New York cannabis recordkeeping requirements, resolve disputes, and enforce our agreements. You may request deletion of your account as described below, subject to information we are required to retain by law.
10. Your Privacy Choices
Depending on where you live, you may have the right to:
- Access, correct, or request a copy of the personal information we hold about you.
- Request deletion of your account and associated personal information, subject to records we must legally retain.
- Opt out of marketing emails at any time using the unsubscribe link, or by updating your preferences in your account.
- Ask us to limit how we use or share your information.

11. Age Requirements & Children's Privacy
The Service is intended only for individuals 21 years of age or older and is not directed to children. We do not knowingly collect personal information from anyone under 21. If we learn that we have collected information from someone under 21, we will delete it and close the associated account promptly.
12. Communications Preferences
We send order-related messages (confirmations, payment reminders, delivery updates) as a necessary part of providing the Service; these cannot be turned off while you have an active order. Marketing emails about new products, promotions and loyalty rewards are sent only if you opt in, and you can unsubscribe at any time without affecting your ability to place orders.
13. Liability
We take reasonable steps to protect your information as described in this policy, but, as with any online service, we cannot guarantee complete security or that unauthorized access will never occur. To the fullest extent permitted by law, our liability for any claim relating to the collection, use or protection of your information is subject to the Limitation of Liability set out in our Terms of Service.
14. Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. We will update the "Last updated" date above and, for material changes, provide additional notice such as an email or an on-site banner. Continued use of the Service after changes take effect means you accept the updated policy.
